WHEN will these mean be FINALLY released? How much more uncovering of LIES and CORRUPTION is needed to convince the authorities to let them out of prison.. not after an investigation, not after their appeal is formalized. .but NOW! Rep. Dana Rohrabacher, R-Calif., plans to reveal today Drug Enforcement Agency investigative reports that confirm a previous WND story presenting evidence the drug smuggler given immunity to testify against border agents Ignacio Ramos and Jose Compean was involved in a second smuggling incident.

The DEA documents and Department of Homeland Security investigative reports already presented by WND contradict the prosecutor, U.S. Attorney Johnny Sutton, who repeatedly has insisted to the public that smuggler Osbaldo Aldrete-Davila was not a suspect under investigation in a second drug incident.

Sutton gave Aldrete-Davila immunity to testify as the prosecution's chief witness regarding the Feb. 17, 2005, shooting incident on the Texas border that led to prison sentences for Ramos and Compean of 11 and 12 years respectively.

In a statement released by his office, Rohrabacher said, "Upon review of these new documents, it is obvious that U.S. Attorney Johnny Sutton knowingly presented a false picture of the drug smuggler in order to justify his ruthless prosecution of Border Patrol agents Ramos and Compean."

Rohrabacher plans to hold a press conference today at 2:30 p.m. Eastern time in the House TV Gallery, H-321, in Washington.

A spokeswoman with Rohrabacher's Washington office confirmed to WND the congressman now has evidence Sutton's office was notified by the DEA of Aldrete-Davila's direct involvement in a second offense.

"Sutton chose to disregard the information, despite the evidence produced by the DEA," Rohrabacher told WND. "Sutton's continuous attempts to paint a benign picture of the drug smuggler is not only disingenuous but amounts to misleading the jury and the public when questioned about the second offense."

Rohrabacher's spokeswoman, Tara Setmayer, told WND the congressman considers the recently obtained DEA reports sufficient basis to demand a new trial.

WND has confirmed with Sutton's office the information contained in the DEA reports matches the information from a Nov. 21, 2005, memo by DHS Special Agent Christopher Sanchez, which was highlighted in a WND story.

According to both reports, Aldrete-Davila brought a second load of 752 pounds of marijuana across the border in bales packed in a 1990 Chevy Astro van he drove Oct. 22, 2005.

The smuggler brought the drug load to the home of Cipriano Ortiz-Hernandez at 12101 Quetzal in Clint, Texas. Ortiz-Hernandez positively identified Aldrete-Davila to DEA investigating agents from police photographs.

WND has obtained both the Texas ID number and the Social Security number of Ortiz-Hernandez.

Texas law enforcement officers confirm both numbers are recorded for Ortiz-Hernandez in current state law enforcement databases. The officers told WND Ortiz-Hernandez has a criminal record in addition to the Oct. 22, 2005, drug investigation.

Rohrabacher spokeswoman Setmayer told WND Sutton's attempt to seal the information about Aldrete-Davila's October 2005 drug offense was an intentional effort to withhold from the jury information the prosecutor knew would discredit the smuggler as a witness, thereby destroying the prosecution's case.

"Sutton chose to hide the second drug offense so he could convict Ramos and Compean, rather than do his duty as an officer of the court in allowing the truth to come out," Setmayer said.

AGUA PRIETA, Mexico — Hundreds of people gathered at a funeral home Tuesday in this border town to pay their respects to slain Police Chief Ramón Tacho Verdugo while state police began work on finding his killers and their motive.

Tacho was gunned down Monday about 5 p.m. as he was leaving the municipal police headquarters in Agua Prieta, across the border from Douglas.

He was pronounced dead a few hours later at a hospital from internal bleeding caused by five gunshot wounds, according to Mexican media reports.

He had been police chief in Agua Prieta since September 2006 and had worked 30 years in law enforcement, including stints as chief in Naco and Cananea and with the state police, said friends and family.

The Sonoran state police weren't releasing any information about the slaying.

But area residents and town officials believe it was related to the work Tacho had done to stop the narcotics traffickers.

The arrests of 39 narcotics traffickers during the six months Tacho was in command likely played into the killing, said Antonio Cuadras Garcia, the mayor of Agua Prieta.

"We still don't know who it was, but we have an intuition as to why," said Cuadras in Spanish. "Commander Tacho achieved an intense, impeccable and efficient labor during the months he was in charge of the Municipal Police Department."

Oscar De La Torre, Mexican Consul General in Douglas, echoed Cuadras' comments after stopping by the funeral.

"This is the reaction to the great results from the program 'Frontera Segura,' for which he was responsible," said De La Torre in Spanish.

The coldblooded slaying of the city's highest-ranking law-enforcement official had community members worried.

"We don't have bulletproof vests or loaded guns," said Mario Botello, 21. "What can we expect?"
What happens if narcotics smugglers open fire on somebody ordering a hot dog from the stand where he works, Botello asked. "It makes you scared, yeah," he said.

Workers at the car wash across the street from police headquarters, Auto Lava Daniel, ran into the offices when they heard the gunfire, said Susan Peralta, manager at the car wash. No one was hurt.

Agua Prieta and the region won't be as safe with Tacho gone, said Heriberto Juvera, of Cananea.
"There is no policeman left with such a strong character to stop the delinquents." Juvera said.
Tacho was well-respected for his toughness and investigative skills, said Ramon Perez and Fernando Perez, local jewelry-store owners who called Tacho a friend. They believe that it was narcotics traffickers who committed the crime. [ Ya think?]

"A good policeman affects the interests of people doing bad work," Ramon Perez said.
A constant flow of friends, family, fellow law-enforcement officers and community members throughout the day Tuesday visited the Funeraria Renacimiento, just two blocks south of the U.S.-Mexican border.

They filled the small chapel where the body was displayed with floral arrangements, said prayers and lingered outside for hours talking about Tacho.

"He was a very good chief," said Sgt. Martin Lopez about his boss. "It hit us hard because he was good with us."

Drug Enforcement Administration officials are looking into the slaying but didn't have information to comment on the motive or what it might mean for the region. [ I know what it means for the region - our southern neighbors will become even MORE lawless and dangerous to us]

There is a special Mass and ceremony planned for today at 10 a.m. in Agua Prieta for Tacho, city officials said.

More on arms seized at U.S. - Mexican border town

23 February 2007: On February 11, 2007, a tractor-trailer registered in Texas and containing a large shipment of weapons, ammunition and a Nissan pickup truck fitted with armor and bullet-proof glass was stopped by the Mexican army in Matamoros, just south of the U.S. border at Brownsville, Texas.

The weapons seized included 18 M-16 assault rifles, including at least one equipped with an M-203 40mm grenade launcher, several M-4 carbines, 17 handguns of various calibers, over 200 magazines for different weapons, and more than 8,000 rounds of ammunition, assault vests and other military accessories.

Although the origin of the shipment is unclear, it is vividly obvious that areas along the U.S.-Mexican border are as much war zones as transshipment points. Matamoros has long been recognized as a vital choke point for the shipment of drugs, weapons and illegal aliens, including Islamic terrorists, into the United States from Mexico. Based on the sophistication of the weapons seized earlier this month, it is apparent that a battle is shaping up just across the border from Brownsville – one that will undoubtedly have ominous implications for those protecting our southern border.

Lou Dobbs discusses DHS memo BOMBSHELL




This memo is enough to show that the prosecution WITHHELD evidence from the defense and that means only one thing - MISTRIAL because there was MISCONDUCT on many levels.

The question is - WHEN???? These men should not be sitting in prison ANOTHER DAY because of this evidence. Now we come to find out the Diane Feinstein investigation is "postponed".. why? Investigators had no plans to bring charges against Texas Sheriff's Deputy Gilmer Hernandez until the Mexican government intervened and demanded it, the officer's supervisor told WND.

Sheriff Don Letsinger of Rocksprings, Texas, said the Texas Rangers were not going to recommend prosecution, but federal law enforcement took over the case in response to the Mexican government's intervention.

Also, in the high-profile case of border agents Ignacio Ramos and Jose Compean, the Department of Homeland Security investigation was opened March 4, 2005, the same date the Mexican Consulate demanded prosecution for the shooting of drug smuggler Osvaldo Aldrete-Davila, according to numerous agency investigative reports authored by Special Agent Christopher Sanchez.

WND can find no documentation of any Border Patrol investigation launched against Ramos or Compean prior to that date.

In both trials, WND has uncovered indications the prosecutor, U.S. Attorney Johnny Sutton, withheld key, possibly exculpatory, information from the defense and the juries.

The prosecutor in the high-profile case that sent border agents Ignacio Ramos and Jose Compean to prison never showed the defense a potentially exculpatory Department of Homeland Security memo.

The document, an April 12, 2005, memo by Special Agent Christopher Sanchez, was first made public by WND in a report published Feb. 6. Mary Stillinger, attorney for Ramos, confirmed she learned of the memo from the WND story.

"This is huge," Stillinger told WND, arguing the government's failure to disclose the document to the defense denied her client his right to a fair trial and establishes the basis for declaring a mistrial.


"The government has a 'Jencks Act requirement' to give us any written statements by DHS Special Agent Christopher Sanchez before the defense cross-examined him," Stillinger told WND.

The Jencks Act requires prior statements of a witness be turned over to the defense before the defense begins cross-examination

"The prosecution could have waited until they questioned Sanchez at trial," Stillinger noted, "but they had an obligation to turn that document over to the defense before we started our cross-examination."

According to the recently published transcript of the Ramos-Compean trial, Stillinger first cross-examined Sanchez Feb. 21, 2006.

Stillinger said the other reason the document should have been disclosed is because the April 12 Sanchez memo is "Brady material" that "could have proved my client innocent."

Under the Supreme Court's 1963 decision Brady v. Maryland, the prosecution is required to turn over to the defense any information that may be exculpatory to the defendant.

As previously reported by WND, the memo lists seven Border Patrol agents and two supervisors who were on the scene of the Feb. 17, 2005, shooting incident for which Ramos and Compean are now in federal prison, sentenced to 11 and 12 years respectively.

The second full paragraph of the DHS memorandum filed by agent Sanchez states:

Investigation disclosed that the following BP agents were at the location of the shooting incident, assisted in destroying evidence of the shooting, and/or knew/heard about the shooting: Oscar Juarez; Arturo Vasquez; Jose Mendoza; David Jaquez; Lance Medrano; Lorenzo Yrigoyen; Rene Mendez; Robert Arnold; and Jonathan Richards.

Of the nine listed agents, two were supervisors, Robert Arnold and Jonathan Richards. Arnold was a supervisory Border Patrol agent and Richards was a field operations supervisor, the senior officer on the field that day. Three of the agents, Vasquez, Jaquez and Juarez, were given immunity by Sutton's office. All were called as witnesses in the case.

The next paragraph of the memo states the DHS investigation concluded the agents on the field Feb. 17 knew about the shooting, assisted Ramos and Compean in picking up the spent shell casings and all failed to report the incident.

Investigation disclosed that none of the above agents, to include Compean and Ramos, reported the shooting or the subsequent cover up when Compean and Vasquez picked up expended brass cartridges (i.e., evidence of the shooting) and threw them away.

"The document couldn't be more important," Stillinger emphasized. "DHS Special Agent Christopher Sanchez makes the defense argument in that report. He points out that none of the seven Border Patrol agents or 2 supervisors on the field reported the shooting, not just Ramos and Compean. Moreover, Vasquez picked up the shells and threw them away, again without the supervisors objecting or filing a report that evidence was being destroyed."

Stillinger stressed Sanchez's report emphasizes why her client Ramos had come to the same conclusion the day of the shooting.

"Ramos thought that surely the supervisors were told about the shooting by all these Border Patrol officers who were standing there on the field discussing the case with their supervisors," she said. "Ramos knew for a fact that several of the Border Patrol agents heard the shooting, so why wouldn't they tell the supervisors?"

Frustrated at the government's decision to withhold the Sanchez memo, Stillinger expressed to WND her distress:

"What the Sanchez memo proves is that if Ramos and Compean were guilty that day, then the other Border Patrol agents who were there and their two supervisors were equally guilty," she said.

Stillinger explained to WND in detail why she considered the memo critical to the defense.

"At the trial, the prosecution acted like it was the most ridiculous thing in the world for my client to have assumed the other agents heard the shooting," Stillinger argued. "Yet here you have a DHS special agent investigating the shooting, and Christopher Sanchez came to the conclusion Ramos came to."

Stillinger maintained this point "goes to the heart of the government's case against my client, that somehow Ramos and Compean 'lied' because they didn't make a point of telling the supervisors, 'We fired our weapons.'"

"Now that we see the Sanchez memo, we find the DHS investigator documented that Ramos and Compean was right in assuming everybody knew," she said.

Illegal Immigration Coalition Boycotts Bank of America


The National Illegal Immigration Boycott Coalition, which includes over 100 organizations, is launching a boycott of Bank of America because of the bank's offer to issue credit cards, mortgages and accounts to illegal aliens in the US.

"People are already canceling cards and accounts with Bank of America over this news," said William Gheen of Americans for Legal Immigration PAC. "The goal of the boycott is to get tens of thousands of Americans to complain to the Bank, ask Congress for action, and to cancel their accounts, until this bank respects public opinion and federal law."

Several online polls show over 80% of the American public disapprove of Bank of America's decision to offer credit cards to illegal aliens, with no Social Security numbers and no credit history.

"It is a slap in the face to every American struggling with credit card debt and rocky credit scores," says William Gheen. "Bank of America needs to realize that the citizens of America run this nation, not big business and current law states it is a felony to aid and abet illegals inside the US. We want Bank of America charged and the decision makers responsible for this to face fines and jail time. We want the Rule of Law restored in America!"

The Coalition launched a boycott of Miller Brewing and their London based parent company SABMiller six months ago.

The anti-illegal immigration groups launched a website to assist the boycott at www.bankofamericaboycott.com where Citizens are encouraged to sign the petition and take action.

The coalition consists of over 100 non-racist organizations such as 9/11 Families for a Secure America, The Conservative Voice, Latino Americans for Immigration Reform, USAPAC, IllegalAliens.us, and many others.

Border agents' trial transcript shows judge ordered information withheld

WASHINGTON – Osbaldo Aldrete-Davila, the Mexican drug smuggler given immunity to return to the United States and testify against two Border Patrol agents, was involved in smuggling a second load of marijuana into the United States after he was given court protection, records have confirmed.

Newly released transcripts of the trial for Jose Compean and Ignacio Ramos have corroborated WND reports that the Mexican illegal alien was involved in the second drug case, this one involving a load of marijuana brought into the U.S. in October 2005.

That followed his grant of immunity by U.S. Attorney Johnny Sutton in return for his truthful testimony against Compean and Ramos, who now are serving 11 and 12 year prison terms following their convictions that they shot Aldrete-Davila as he was fleeing back into Mexico.

A number of activist organizations have been so outraged by the agents' predicament for doing what many people believe was no more than their reasonable duties there have been repeated calls to President Bush to issue pardons to the former agents.

The transcript shows that during the trial conference with the prosecution and defense lawyers, the judge talked about Aldrete-Davila's second offense in an equally matter-of-fact way.

The transcript shows Cardone commenting as follows:

"In other words, all the investigation they've (government) done to investigate this case leads up to him (Aldrete-Davila) coming into the country, and then in October committing this second involvement. Okay? But there's no lying, if that's what we're characterizing it as, until the October incident."

Rep. Dana Rohrabacher, R-Calif., told WND that the trial transcript now makes clear that "the prime witness against these two Border Patrol agents was involved in another major load of drugs and the prosecution made a conscious decision to keep these facts from the jury."

At the trial, Cardone ruled that Aldrete-Davila was not on trial. She ruled that no reference about the October 2005 drug offense was to be made to the jury and she sealed all records concerning that offense, despite vigorous defense objections that this information not only violated Aldrete-Davila’s immunity grant, but also went to the heart of the defense argument that Aldrete-Davila's testimony was not credible.

Rohrabacher expressed continued outrage that Sutton had decided to grant immunity to an admitted drug dealer so he could prosecute two Border Patrol agents who were trying to apprehend him.

"Once Aldrete-Davila was caught a second time," Rohrabacher told WND, "it unmasks the indefensible nature of the prosecutor's decision to go after the Border Patrol agents. If the jury is not allowed to know about Aldrete-Davila's second offense, then Ramos and Compean did not get a fair trial."

The revelation also "raises questions whether what we're talking about here is two honest Border Patrol agents who stumbled across a drug cartel operation and are being punished for coming up against the power of the cartel," Rohrabacher said. "The second drug incident makes clear that Aldrete-Davila's profession is drug smuggling."

Rohrabacher was harshly critical of both Sutton and President Bush.

"What Ramos and Compean got was a screw job from day one by the U.S. attorney's office in order to send a message to all Border Patrol agents," Rohrabacher told WND. “The message from Sutton was that the President of the United States makes policy on the border, so don't get in the way. If you haven't gotten the message yet, this is an open border."

He said Sutton was running a "public relations campaign," and charged that Sutton's purpose has been to "poison the well of public opinion, calling Ramos and Compean corrupt, when there never were any corruption charges, then suggesting they shot an unarmed man in the back, when we only have (the) drug dealer's word he was unarmed and the medical evidence is that he was not shot in the back."

"In the Ramos-Compean case we have lie after lie after lie coming out of Sutton's office. And now we've got a public relations campaign to protect Sutton because he is a protégé of the president and the president doesn't want to see his career destroyed," the congressman told WND.

Rep. Ted Poe, R-Texas, was equally critical of the prosecution.

"It would now appear that Aldrete-Davila was not some innocent, poor migrant mule bringing narcotics into the United States so he could buy medicine for his sick mother," he said.

"From a reading of the trial transcript, it would now appear that there is at least one more case of bringing drugs into the United States illegally involving Aldrete-Davila," he said.

Poe also felt this information should have reached the jury. "If the jury would have heard about this second instance, it certainly would have affected the drug smuggler's credibility. The drug smuggler was the prosecution's case. This star witness, Aldrete-Davila, had a lot of baggage, no pun intended."

WND has previously reported that the prosecution provided Aldrete-Davila with a multiple-use border pass signed by Homeland Security Special Agent Christopher Sanchez, along with his badge number.

WND also had specifically asked Sutton a broadly framed question, whether "there was any second incident of any kind involving Aldrete-Davila." He responded by denying that the prosecution's star witness was involved in any second drug incident, but the trial transcript now available appears to directly contradict Sutton’s denial.

Why May 1st is chosen for "Day Without Immigrant"

The correct title of this day should really be "Day Without an Illegal Alien" and according to Wikipedia this is the significance of having chosen May 1st:

May Day is now more commonly celebrated as a commemoration of the Haymarket Riot of 1886 in Chicago, United States which occurred on May 4, but was the culmination of labor unrest which began on May 1. The date consequently became established as an anarchist and socialist holiday during the 20th century, and in these circles it is often known as International Workers' Day or Labour Day. In this form, May Day has become an international celebration of the social and economic achievements of the working class and labor movement.

One pro-illegal guy (Nativo Lopez) wants May 1st to become a FLOATING HOLIDAY. That would be the epitome of outrageous since it has COMMUNIST significance. You better believe there will be a HUGE backlash if that is even considered by any politicians.

Activists split over new 'Day Without an Immigrant'

A proverbial split in the ole armor I see. Well maybe they realized that most of America was HAPPY to have a day without illegal aliens!

NORTH COUNTY ---- Immigrant rights activists from Los Angeles say they plan to repeat last May's "Day Without an Immigrant" boycott in which many immigrants passed on work and school to protest what they called unfair immigration proposals, but local activists say a second such protest may not be a good idea.

Local activists for the immigrant community are still considering whether they would participate in another national day of protest. But other state and national figures, including Dolores Huerta, a leading Latino rights activist who co-founded the United Farm Workers with Cesar Chavez, say they would not support a boycott.

One of the main concerns among those opposing this year's boycott is fear of a backlash against the community. Some say a boycott could lead to workers losing their jobs, students being expelled and further emphasizing critics' views of Latinos as outsiders.


Last year's protest created some public backlash from anti-illegal immigration groups who called the boycott irreverent and misdirected.

Bill De La Fuente, who founded a North County-based Latino Merchants Association, said he supported last year's protest, but he is not sure he will again this year.

Youtube attacking my right to free speech now

So very interesting that they chose the America's Most Wanted segment on the Border Agents to attack as "copyright infringement". I plan to fight this with the Fair Use Doctrine but just wanted to give all youtubers a heads up if you hit a nerve, they will come after you.

Oh and by the way.. there are TONS of the SAME SEGMENT from AMW on the Border Agents STILL up on YouTube. So if 20th Century Fox really had a complaint, don't you think they would go after ALL the youtubers who posted this?

I believe it is someone posing as 20th Century Fox and I will get to the bottom of it and expose them. In the mean time - you can see the video by searching in youtube for "America's Most Wanted" - you will find several on the Compean/Ramos segment posted.

So it seems Rene Sanchez, the Border Agent now in Willcox AZ Border Patrol Station and this Christopher Sanchez must be related - cousins or brothers or what? They both seem to have grown up with Mexican drug smuggler Aldrete-Davila. So.. let me ask a stupid question.. Doesn't DHS and the Border Patrol do background checks before they hire people? Why on EARTH would they allow a person with ties to a Mexican drug smuggler be hired into a position tasked with stopping the flow of Mexican drugs? Is it just me or does that seem stupid? Sort of like the fox guarding the hen house... The question remains as to how many other people are in DHS who have ties to oh I don't know.. maybe an Islamic extremist or two?

Oh and let's not forget that these agents are in prison for longer than many MURDERERS, DRUG DEALERS and RAPISTS. And what they were supposedly guilty of.. not filing a report.. which we now know is NOT TRUE.. is equivalent to what Martha Stewart did and look at where she spent HER measely couple of years .. at Camp Cupcake... not in general population where she could get murdered by the people she put in prison.. The Enron executives who stole millions from regular hard working people got.. how many years in prison? Two of them faced over 10 years in prison - Michael Kopper and Mark Koenig - what did they get? less than TWO YEARS!

Border-agent investigator had tie to smuggler

Played major role in Ramos-Compean case but name blacked out in report

According to official documents in WND's possession, a Department of Homeland Security agent played a major role in managing the drug smuggler and conducting the field investigation in the incident that landed Border Patrol officers Ignacio Ramos and Jose Compean in federal prison for more than a decade.

Yet, in the heavily redacted 77-page DHS report submitted to Congress Wednesday there is no explicit discussion of the role DHS Special Agent Christopher Sanchez played in the case.

Rep. John Culberson, R-Texas, yesterday called for the resignation of four DHS investigators, including Assistant Inspector General Elizabeth Redman, after DHS Inspector General Richard Skinner testified under oath his deputies had lied to Congress about non-existent reports that were supposed to have established Ramos and Compean as rogue cops who wanted to "shoot some Mexicans."

WND has obtained a copy of the government-issued border pass given to Osbaldo Aldrete-Davila, the drug smuggler granted immunity to testify against Ramos and Compean. The border pass allowed multiple entries to the U.S. and carried the signature and badge number of Sanchez.

The border pass appears to have been issued March 16, 2005, the day Sanchez brought Aldrete-Davila to William Beaumont Army Medical Center in El Paso, Texas, to have a bullet removed from his right thigh.

"Aldrete-Davila was issued what amounts to a 'Gold Elite' border pass," Andy Ramirez, chairman of the Friends of the Border Patrol, told WND. "With the stamp for multiple entries into the United States, Aldrete-Davila didn't have to run the back roads as a drug smuggler any more. He could tell his drug bosses in Mexico that he could drive their loads right through border crossing points without much worry."

WND previously reported Aldrete-Davila was implicated in a second drug bust in October 2005, subsequent to the Feb. 17, 2005 incident with Ramos and Compean in which he abandoned a 1989 Ford Econoline containing 743 pounds of marijuana driven across the border from Mexico.

"With that border pass, Aldrete-Davila had the green light," Ramirez told WND. "He might have been indicted if the vehicle he drove in October 2005 with 1,000 pounds of dope was identified back to a border-crossing photograph, but he probably never had to be arrested."

The prosecutor of Ramos and Compean, U.S. Attorney Johnny Sutton, has told WND that Aldrete-Davila was never arrested a second time for a drug offense in October 2005, but Sutton has never denied the smuggler was indicted for such an offense.

Medical records obtained by WND clearly establish the bullet wounds suffered by Aldrete-Davila involved a lateral wound to the left buttocks, not a "shot in the back" as repeatedly claimed by Sutton.

The medical records document that March 16, 2005, Dr. Winston Marne removed a large bullet fragment from Aldrete-Davila's right thigh. The records indicate bullet fragments were found in Aldrete-Davila's pelvis but not removed. The path of the bullet is clearly described as entering in the left side of the left buttocks, traversing the groin area, and lodging in the right thigh.

The records also indicate reconstructive surgery was performed on Aldrete-Davila the same day at the army hospital. Damage to the urethra required a catheter to be inserted. Aldrete-Davila was placed under anesthetics for the operation and was heavily sedated for pain.

The drug smuggler was released from the army hospital the same day and given to the protective custody of Sanchez, who also took with him the bullet fragment removed from Aldrete-Davila's thigh.

WND has learned Aldrete-Davila spent the night of March 16, 2005, at the home of Sanchez.

"Christopher Sanchez shows up again with the shell fragments from Aldrete-Davila's body," Ramirez pointed out to WND. "Sanchez was evidently Aldrete-Davila's handler and from the looks of it, he did a good job. Taking that bullet home broke the chain of evidence. From there on, what good would a report be even if it established the bullet was fired from Ramos' gun?"

WND previously reported that the weapons identifications ballistics analysis performed by the Texas Department of Public Safety on the bullet fragment held by Sanchez did not match the bullet to the weapons fired Feb. 17, 2005 by Ramos or Compean.

March 16, 2005, was also the date "Osvaldo" Aldrete-Davila signed and accepted his offer of immunity from Sutton's office, supposedly signed before the medical operation was performed and the border pass issued. There is no time stamp noted on the immunity document nor mention of the location where the document was signed.

As WND reported, Sanchez grew up with Aldrete-Davila in Mexico, and the drug dealer's identity was first discovered through these family connections.

WND repeatedly has noted many of the DHS investigative reports were filed by Sanchez, who appears to have played a major role in the DHS field investigation.

"There was no reason to have redacted Christopher Sanchez's name from the report," Ramirez told WND. "Sanchez was a DHS special agent. But everywhere you look, Sanchez shows up playing a role shepherding the drug dealer around and framing the evidence that ended up being used by Johnny Sutton to put Ramos and Compean in prison for 11 and 12 years respectively."

Officials urged to resign for lie about border agents
Congressman calls for ouster of DHS deputies after IG admits agency gave false information

A Republican congressman is calling for the resignation of Department of Homeland Security officials who he says lied about the case of two Border Patrol agents imprisoned for their actions in the shooting of a drug smuggler.

As WND reported, at a congressional hearing yesterday, Rep. John Culberson of Texas confronted DHS Inspector General Richard Skinner about his agency's claim it had documentary proof of the guilt of former agents Ignacio Ramos and Jose Compean.

"Richard Skinner admitted yesterday under oath that his top deputies gave members of Congress false information painting Border Patrol agents as rogue cops who were not in fear for their lives and who were 'out to shoot Mexicans,'" Culberson said in a statement.

Culberson said he believes false information was given to congressmen to "throw us off the scent and cover up what appears to be an unjust criminal prosecution of two U.S. law enforcement officers whose job was protecting our country's borders from criminals and terrorists."


The admission came during Skinner's testimony before the Homeland Security Subcommittee of the House Appropriations Committee. Culberson was asking questions about a meeting DHS officials had Sept. 26 with him and three other Republican congressman from Texas, Reps. Ted Poe, Michael McCaul and Kenny Marchant.

WND previously reported that at that meeting Skinner's office asserted it had documentary evidence Ramos and Compean:

1. confessed to knowingly shooting at an unarmed suspect;

2. stated during the interrogation they did not believe the suspect was a threat to them at the time of the shooting;

3. stated that day they "wanted to shoot a Mexican";

4. were belligerent to investigators;

5. destroyed evidence and lied to investigators.

Ramos and Compean began prison sentences last month of 11 and 12 years respectively.

Yesterday, under questioning by Culberson, Skinner admitted DHS did not in fact have investigative reports to back up its claims.

"The person who told you that misinformed you," Skinner reportedly replied.

This prompted a startled and angry response from Culberson, who charged Skinner's office with lying to the Texas congressmen and painting Ramos and Compean as dirty cops.

In his statement today, Culberson accused the DHS of leaving U.S. borders "largely undefended" and deploying National Guard troops "whose 'standard operating procedure' is 'to retreat' when confronted with armed criminals."

The "unjust" prosecution of Ramos and Compean, he said, "weakens border security by discouraging all U.S. law enforcement officers from drawing their weapons in self-defense or in the defense of our nation."

"Our highest priority in the war on terror is to secure our borders," Culberson said. $10 million cocaine drug bust in Philadelphia

Cocaine worth millions seized

Acting on a tip, city police stopped a truck and found 100 kilos of cocaine packed in boxes of rotting fruit.

Somewhere, a drug lord just lost his happy face.

Philadelphia police yesterday seized 100 kilograms of cocaine worth $10 million that had been stashed amid boxes of moldy papayas inside a tractor-trailer.

"This is the biggest seizure in the history of the Philadelphia Police Department," said Police Commissioner Sylvester M. Johnson at a news conference last night at a police facility in Feltonville.

That's where the tractor-trailer - also packed with pallets of aloe vera, peppers and limes - was unloaded with a forklift over the course of several hours last night.

The drug bust came one day after police announced the seizure of $1.5 million in marijuana and Ecstasy pills.

Last year, the department confiscated $140 million worth of drugs - the highest amount in city history. Already this year, the police have seized more than $15 million worth, Johnson said.

Late Monday night, police were tipped off that a truck carrying drugs was parked at a location in Northeast Philadelphia, said Chief Inspector William Blackburn, head of the Narcotics Bureau.

Around 7 a.m. yesterday, the truck was driven onto Interstate 95 south to the Aramingo Avenue exit. Narcotics officers following the truck decided to stop it in a Kmart parking lot in Port Richmond.

Police brought a K-9 unit to the scene and a drug-sniffing dog registered a hit - an indication that drugs were on board.

The truck was taken first to the Frankford Arsenal, then to the Feltonville facility, at Macalester Street and Whitaker Avenue, where it was unloaded.

In the middle of the trailer, investigators found 100 one-kilo packages of cocaine wrapped in black electrical tape inside boxes of rotting fruit.

Two men were arrested: Marcus Diaz, 46, of Texas, the driver; and Rubin Boria, 30, of Holmesburg, who was picked up by Diaz in Philadelphia. They face numerous drug charges. Both men, who have criminal records, were not armed.

Blackburn said that Diaz drove the truck from Texas and that the drugs were destined for the neighborhoods of Philadelphia.

A narcotics officer said each kilo was worth about $25,000 wholesale.

So the shipment's wholesale value is about $2.5 million.

But once cocaine is diluted for street sales, its value sharply increases.

Obviously the cocaine came north through the Mexican border, but its source was unknown, police said.

"I don't know if this will make a dent" in Philadelphia's drug problem, Johnson said. "But this is $10 million in cocaine that won't hit the streets of Philadelphia."

A Department of Homeland Security official admitted today the agency misled Congress when it contended it possessed investigative reports proving Border Patrol agents Ignacio Ramos and Jose Compean confessed guilt and declared they "wanted to shoot some Mexicans" prior to the incident that led to their imprisonment.

The admission came during the testimony of DHS Inspector General Richard L. Skinner before the Homeland Security Subcommittee of the House Appropriations Committee, according to Michael Green, press secretary for Rep. John Culberson, R-Texas.

Culberson was questioning Skinner about a meeting DHS officials had Sept. 26 with him and three other Republican congressman from Texas, Reps. Ted Poe, Michael McCaul and Kenny Marchant.


WND previously reported that at that meeting the DHS Inspector General's office asserted it had documentary evidence Ramos and Compean:

1. confessed to knowingly shooting at an unarmed suspect;

2. stated during the interrogation they did not believe the suspect was a threat to them at the time of the shooting;

3. stated that day they "wanted to shoot a Mexican";

4. were belligerent to investigators;

5. destroyed evidence and lied to investigators.

Under questioning by Culberson, Skinner admitted DHS did not in fact have investigative reports to back up the claims: "The person who told you that misinformed you," Skinner reportedly replied.

This prompted a startled and angry response from the congressman.

"You lied to me and you lied to all of us," Culberson charged. "Your office tried to paint a picture of Ramos and Compean as dirty cops, and now you come before this committee and tell us you never had the information to back up those claims."

Ramos and Compean began prison sentences last month after their actions in the shooting of a drug smuggler who was granted immunity to testify against them.

Responding to Skinner's testimony yesterday, Poe said it "explains why DHS has been stonewalling Congress."

"DHS didn't turn over the reports to us to back up their September 26 accusations for one simple reason – the reports never existed," the Texas congressman said.

"Why did it take DHS four months to admit their error?" he asked. "I wonder how much more has DHS told the public and Congress about Ramos and Compean that simply isn't true?"

Poe said he's determined to get to the bottom of DHS's claim.

"I expect this new revelation will lead to a lot more questions before we're done," he said.

Andy Ramirez, who has been involved with the case as chairman of Friends of the Border Patrol, told WND the DHS's actions "represent obstruction of justice, and they should be held in contempt of Congress, and, if possible, prosecuted to the full extent of the law."

"This admission today is yet more proof of how they are willing to distort the facts, as I have charged all along, in order to ensure a conviction," he said.

State Republican Parties Join Calls To Free Border Agents

(CNSNews.com) - A growing number of Republicans are calling on President Bush to pardon two U.S. Border Patrol agents who shot and wounded a Mexican man suspected of smuggling drugs into this country. Republican parties in two states have now weighed in on the matter.

The case sparked public outrage and prompted three congressional proposals to free agents Ignacio Ramos and Jose Compean, who this month began serving prison sentences of 11 and 12 years, respectively.

At an Arizona Republican Party Convention at the weekend, delegates unanimously approved a resolution urging Congress to approve House Resolution 563, which seeks to pardon Ramos and Compean.

It's typically up to the president to issue pardons, but -- as Rep. Duncan Hunter (R-Calif.) said after introducing the bill -- the authority of Congress to pardon has not yet been tested in the courts. Hunter's bill has 70 co-sponsors.

The Arizona resolution said the state GOP "strongly supports our Border Patrol agents and H.R. 563."

Not every Arizona Republican backs that position, however.

Rep. Jeff Flake (R-Ariz.) opposes both his state party's resolution and the proposal in Congress to pardon the individuals.

"The two men were convicted by a court of law and the congressman respects the court's decision," Flake spokesman Matt Specht said Wednesday.

Meanwhile in Texas, where the case was prosecuted, about 3,100 Republicans on the state GOP's e-mail list have responded to an online petition to pardon the two agents. The petition, organized by the state party, was sent directly to the White House.

Hans Klingler, spokesman for the Texas Republican Party, insisted that the petition was not an attempt by the state party itself to call for a pardon.

"We heard the grassroots around the state and presented this on-line petition to the president," Klingler told Cybercast News Service. "We did not take a position as a party. We wanted to give the grassroots the power to express themselves."

President Bush said earlier this month he would consider granting a pardon to the two agents after reviewing the facts of the case.

The California Republican Party has not called for action in the matter, but Rep. Dana Rohrabacher (R-Calif.) said he would consider pushing for something similar.

"We need to put pressure on the president from as many different directions as possible," Rohrabacher told Cybercast News Service. "Anybody who wants to sign a petition or call the White House should do so, and anybody who wants to start a petition or start an effort to call the White House should do so. I'm supportive of all those efforts.

"There aren't pejorative words bad enough to describe President Bush's attitude if he permits these Border Patrol agents to continue to languish in prison and their families destroyed," he added.

Much of the anger stems not only from the fact that a case was brought against the agents, but the tenacity with which U.S. Attorney Johnny Sutton pursued the matter. He tracked down Osvaldo Aldrete-Davila, the Mexican who was shot while fleeing the federal border agents, and offered him immunity in exchange for his testimony against the agents.

The agents encountered Aldrete-Davila in Texas in February 2005. He was driving a van later found to contain 743 pounds of marijuana. When the Aldrete-Davila abandoned the vehicle and tried to run back into Mexico, the agents shot him in the buttocks.

After the shooting, the agents discarded their spent shell casings and didn't inform their supervisor about the incident.

Sutton contends that his office has the responsibility to uphold the rule of law, even when it extends to law enforcement agents. He stressed the fact that the smuggler was unarmed when fleeing and that the agents attempted to cover up their crime.

Further, Sutton said, the smuggler left no fingerprints in the van containing 743 pounds of marijuana, and thus the government gave nothing away in granting him an immunity deal.

The agents' defense argued unsuccessfully that Compean and Ramos believed Aldrete-Davila was armed.

After a two-week trial, Ramos and Compean were convicted of assault with a dangerous weapon, assault with serious bodily injury, discharge of a firearm during the commission of a crime of violence, willfully violating the illegal immigrant's constitutional rights, lying about the incident and failing to report the truth.

Meanwhile, Aldrete-Davila is preparing to sue the federal government for $5 million for violating his constitutional rights (see related story).

The transcript of the trial has not yet been released to the public. Further, members of Congress have been unsuccessful in obtaining information about the case from the Justice Department.

Sutton told Cybercast News Service last week that evidence of a subsequent drug smuggling offense was brought up at the trial of the two agents but was not allowed to be discussed because the second matter was under investigation and not part of the original immunity deal.

In the alleged second offense, Aldrete-Davila reportedly tried to smuggle 1,000 pounds of marijuana into the United States.

Perhaps we should all let him know how we feel about his TREASON. It is preposterous to allow a foreign national sue our government. I am sure there are precedents where this was not allowed. We need to dig these cases up and put an end to this insanity now

On the other hand if it is allowed to continue and the government maybe gets OJ Simpson's lawyer, we have a chance to uncover the TRUTH in this case and blow the freaking lid off it and get the agents out of prison, and uncover the trail of corruption starting in El Paso and ending in the White House.

Prosecutor accused of hiding smuggler's 2nd drug bust

The judge in the high-profile case of two U.S. Border Patrol officers imprisoned after shooting and wounding a Mexican drug smuggler allegedly sealed key testimony and issued gag orders preventing the defendants, their families and trial participants from discussing the smuggler's involvement in a second drug bust – for which he again was granted immunity in order to testify against the agents.

According to Andy Ramirez, chairman of Friends of the Border Patrol, and reliable sources close to the case, Osbaldo Aldrete-Davila was apprehended in an October 2005 drug bust with 1,000 pounds of marijuana. That incident followed the Feb. 17, 2005, confrontation with Ramos and Compean in which Aldrete-Davila drove a van illegally across the Texas border into Mexico with 743 pounds of marijuana. Ramos and Compean were convicted for their actions surrounding the shooting of drug smuggler and sentenced to 11 and 12 years in prison respectively.

Ramirez told WND that Aldrete-Davila had been positively identified in a drug bust just prior to the Ramos-Compean trial, which began Oct. 17, 2005.

"When Johnny Sutton learned that Aldrete-Davila was involved in this second bust, he panicked," Ramirez said. "If the public learned that Aldrete-Davila came back to the United States a second time with another load of marijuana, Sutton was sure that would blow his case against Ramos and Compean."

The prosecutor, U.S. Attorney Johnny Sutton, previously has denied there was a second arrest. But sources say Aldrete-Davila technically was apprehended for the second incident, and not arrested, on condition he testify against Ramos and Compean.

Yesterday, Sutton's spokeswoman, Shana Jones, declined to answer specifically whether there was a second border incident of any kind involving Aldrete-Davila. She told WND the attorney's office is standing on its original statement that there was no arrest, no indictment and no prosecutable evidence.

According to reliable sources close to the case, Sutton asked Judge Kathleen Cardone to seal the records involving Aldrete-Davila's participation in the second drug bust. Subsequently, Aldrete-Davila's name was expunged from the law enforcement records concerning the October 2005 incident at the request of Sutton's office.

Cordone's gag order in the trial covered any discussion by the attorneys or the families of the officers concerning Aldrete-Davila's second drug bust.

WND was told that Sutton withdrew a Resident Alien Card, commonly known as a "green card," from Aldrete-Davila after the October 2005 drug bust. The green card originally had been given to Aldrete-Davila as an inducement to return to the U.S. and testify as a star witness against Ramos and Compean under a grant of immunity from prosecution.

WND has learned the witness who identified Aldrete-Davila in the second drug incident was identified as "Toquinto."

Toquinto is the surname of Border Patrol agent Rene Sanchez's mother-in-law, as noted in the Department of Homeland Security Memorandum of Activity report filed by DHS Special Agent Christopher Sanchez, dated March 14, 2005.

As previously reported by WND, Renez Sanchez and Aldrete-Davila grew up together in Mexico. The information that Aldrete-Davila was the Mexican drug smuggler involved in the Feb. 17, 2005, incident with Ramos and Compean originated in a phone call between Sanchez's mother-in-law, Gregoria Toquinto, and Aldrete-Davila's mother, Marcadia Aldrete-Davila.

Prosecutor Debra Kanof of Sutton's El Paso office told the defense counsel and the court at the Ramos-Compean trial, without the jury present, Aldrete-Davila was pleading a Fifth Amendment privilege not to testify against himself in "any other criminal activities."

The indictment against Aldrete-Davila for the October 2005 drug incident reportedly was sealed at Sutton's request in order to preserve Aldrete-Davila's credibility as the government's star witness against Ramos and Compean.

Sanchez testified at the Ramos-Compean trial as a character witness for the drug smuggler, with whom he had grown up in Mexico.

WND has asked several Ramos and Compean family members to verify this account, but all declined, expressing fear that Cardone would then have reason to prosecute them for violating the gag order.

Both wives told WND that Sutton would prosecute them for contempt of court and would not hesitate to put them in prison if they talked about any information covered by the gag order.

Ramirez said that after Sutton learned about Aldrete-Davila's second drug bust, he "made sure nobody would ever be able to prove anything about it."

"Sutton took back the green card he gave Aldrete-Davila as an inducement to testify against Ramos and Compean under immunity, and he refused to give Aldrete-Davila any more medical care at government expense at the Army hospital in El Paso."

Ramirez asserted that on the day the jury was being picked, the prosecution asked for postponement of the trial – not because Aldrete-Davila needed additional medical surgery in El Paso as the prosecution claimed, but because the prosecution needed time to cover up the second drug bust.

"Aldrete-Davila never was taken to El Paso for another operation," Ramirez told WND. "It was all a lie. All Sutton wanted to do was to seal and then expunge the criminal records on the second drug bust, so nobody would ever be able to prove anything against his drug smuggler witness. If the second drug bust had come out to the jury, the jury would never have believed a word he said."

At Sutton's request, the Ramos-Compean trial was postponed from its originally scheduled October 2005 date to February 2006.

In his Jan. 19 interview with WND, Sutton claimed he would have been willing to prosecute Aldrete-Davila if he could prove a second offense.

"If I had a provable case that Aldrete-Davila had committed other crimes, I could prosecute him."

WND called Cordone's office but was told the judge would answer no questions from the press about the Ramos-Compean case.

Her office refused to tell WND when or if a trial transcript would be available, or how much a copy of the trial transcript would cost.

The judge's office also refused to explain why the court was taking nearly a year to prepare and release the transcript.
