Let's sue the Federal Government if they pass any kind of amnesty

Just like all of OUR laws are being blocked by judges and getting challenged... in Hazleton, in Farmer's Branch, in Escondido and NOW Oklahoma.. we can do the same damn thing if the Senate passes any kind of "comprehensive immigration reform" that includes ANY amnesty. We can sue for pain and suffering of the American people which illegal immigration has wrought and which amnesty will only worsen. We have rights too dammit and it's time we start to flex them!

Calling all lawyers. Calling the ACRU. Let's get ready to fight it if any kind of amnesty passes.

Comments:
Hmmm....what will your standing be under Article III?

Oh you mean this sectino of Article III?

Section 3. Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.

I think there are a lot of public officials who have committed treason against this country and for that, they should be at the very least removed from office and at the worst, imprisoned for life.

It is time for us to RECALL officials who act AGAINST this country - get them OUT and get the Senators out who act like the British Royalty like Arlen Specter and Ted Kennedy - TERM LIMITS for crying out loud! Why do we have to keep putting up with these cretins year after year????

I just think your idea to sue the government for nonimmigration enforcement sounds a lot like tax payer lawsuits (like here http://en.wikipedia.org/wiki/DaimlerChrysler_Corp._v._Cuno ) which courts throw out all the time.

As for treason, you should probably read this little primer on volokh beforehand: http://volokh.com/posts/1089159959.shtml

Well if the ACLU and the PRLDEF can sue our local governments for trying to enforce immigration laws, then we can certainly sue governments for NOT enforcing laws. What is good for the goose is good for the gander. We are tired of having our efforts to pass tough illegal immigration ordinances be challenged by these traitors so we will be prepared to challenge amnesty if it passes the senate. If a judge thinks that is not worthy of pursuing then I think that will be the final straw and it will toss this nation into a bloody civil war. We are almost there already.

The difference is that they can demonstrate an injury in fact through group standing. Group standing will not apply to you here because as opposed to representing a specific person with a concrete injury (like abortion and Planned Parenthood or an immigrant and Maldef) your group will be representing just the "general disgruntled citizenry" like in a taxpayer lawsuit case, leaving an Article III court (federal courts) without jurisdiction. Even if you surpassed that hurdle, as a substantive matter, you will not have a case because immigration is an issue firmly within the perogative of the federal government. Although you may disagree with their decisions, mere disagreement does not equate to treason, especially when the treason is in passing a law using constitutional means. In short, you have no shot.

We will find plenty of cases where American citizens were denied benefits due to lack of funding because that funding has been allocated and used by illegal aliens. We will find plenty of cases where people lost jobs to illegal aliens or lost contracts because other companies employ illegal aliens and can undercut them. It is ultimately the failure of the US government to enforce immigration laws that are at the root of all of this so this is where blame should be placed. It would be a class action suit involving thousands of harmed people vs the Federal government.
Si se puede! (yes we can!)
